These Terms & Conditions ("Terms") govern your access to and use of B4-UGO Safety ("Service," "App," "we," "us," or "our"), operated by B4-UGO Services Ltd. By creating an account or using the Service, you agree to be bound by these Terms.
B4-UGO Safety is a personal safety and emergency notification platform that allows users to set timed messages automatically sent to trusted contacts if not cancelled, send immediate emergency alerts to trusted contacts via email, SMS, and push notification, share GPS location during emergency events, and manage a network of trusted contacts.
B4-UGO Safety is a notification and communication tool only. It is not an emergency response service. See our Emergency & Safety Disclaimer.
These Terms, together with our Privacy Policy, Emergency & Safety Disclaimer, and Data Deletion Policy, constitute the entire agreement between you and B4-UGO Services Ltd. regarding the Service. We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification. Your continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.
By accessing, downloading, installing, or using B4-UGO Safety, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
Your acceptance is recorded electronically including the date, time, and version of these Terms. Electronic acceptance is legally equivalent to a written signature.
You consent to the collection, storage, and processing of your personal data as described in our Privacy Policy, including account registration data, GPS location data (when permission is granted), message content, notification delivery records, and usage analytics. You consent to receive emergency alert notifications, timer warning notifications, and account-related communications via email, SMS, and push notification. You acknowledge that B4-UGO Services Ltd. may disclose your information when required by valid legal process.
2.1 Age Requirement. You must be at least 18 years of age (or the age of majority in your jurisdiction) to create an account. The Service is not directed to children under 13 (or the applicable age of digital consent in your jurisdiction). We do not knowingly collect data from children. If we become aware that we have inadvertently collected personal information from a person under 18, we will immediately suspend the account and delete all associated personal data within 72 hours.
2.2 Legal Capacity. You confirm that you have the legal capacity to enter into this agreement.
2.3 One Account. You may maintain only one account per person. Creating duplicate accounts is prohibited.
3.1 Accurate Information. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
3.2 Account Security. You are solely responsible for maintaining the confidentiality of your account credentials and security codes. You are responsible for all activity that occurs under your account.
3.3 Account Verification. We may verify account information and request additional documentation to confirm identity.
4.1 Paid Plans. After the trial period, continued access requires a paid subscription. Current pricing is available at b4-ugo.com.
4.2 Payment. Payments are processed by Stripe. By subscribing, you authorize recurring charges to your payment method.
4.3 Cancellation. You may cancel your subscription at any time through b4-ugo.com or by contacting support@b4-ugo.com. Access continues until the end of the current billing period.
4.4 Refunds. Refund requests are evaluated on a case-by-case basis. Contact support@b4-ugo.com within 14 days of a charge for refund consideration.
5.1 Trial Period. New users receive a 90-day free trial with full access to all features.
5.2 Trial Expiration. Upon trial expiration, Premium features are locked until an active membership is obtained. All user data, Trusted Friends, timers, messages, and settings are preserved and will be fully restored when a membership is activated.
5.3 No Charges. The free trial does not require payment information. No charges will be made during the trial period.

You must not use B4-UGO Safety to:
7.1 False Alerts — Send false, fabricated, or misleading emergency alerts; trigger emergency features for testing or entertainment without marking them as tests; or misrepresent your location or safety status.
7.2 Harassment and Abuse — Harass, threaten, intimidate, or harm trusted contacts or other users; use the platform to stalk or surveil any individual; or transmit abusive, offensive, or defamatory content.
7.3 Unauthorized Access — Attempt to access accounts, systems, or data you are not authorized to access; circumvent or disable authentication or security controls; or probe, scan, or test system vulnerabilities without written authorization.
7.4 Spam and Misuse — Send unsolicited bulk messages through the platform; use the Service for commercial solicitation without authorization; or add individuals as trusted contacts without their knowledge or consent.
7.5 Illegal Activity — Use the Service in violation of any applicable law or regulation; transmit content that infringes intellectual property rights; or facilitate fraud, identity theft, or financial crimes.
7.6 Technical Abuse — Reverse engineer, decompile, or disassemble the Service; introduce malware, viruses, or malicious code; overload, flood, or otherwise impair Service infrastructure; or use automated scripts or bots to interact with the Service.
7.7 Impersonation — Impersonate B4-UGO Safety, its employees, or other users; or create misleading sender information in alerts or messages.
Violation of this Section may result in immediate account suspension or termination and may expose you to legal liability if false reports cause harm.
All content, trademarks, logos, software, and technology associated with B4-UGO Safety are owned by or licensed to B4-UGO Services Ltd.
8.1 Ownership. B4-UGO®, B4-UGO Safety, and all related software, features, designs, content, databases, user interfaces, graphics, logos, trademarks, source code, workflows, documentation, and proprietary technology are owned by B4-UGO Services Ltd. and are protected by applicable copyright, trademark, trade secret, and intellectual property laws. 8.2 License Grant. Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the application solely for its intended purposes and in accordance with these Terms. No part of this application or service may be copied, reproduced, modified, distributed, published, reverse engineered, decompiled, disassembled, sold, licensed, sublicensed, transferred, or used to create derivative works without written authorization. All rights not expressly granted are reserved.
8.3 Prohibited Activities. The following are strictly prohibited: copying application features or proprietary workflows; reverse engineering or extracting source code; creating competing products using proprietary B4-UGO functionality; unauthorized use of trademarks, branding, or logos; automated scraping or harvesting of application data; and commercial exploitation without written permission.
8.4 User Content. You retain ownership of content you create within the Service (messages, trusted contact lists). You grant B4-UGO Services Ltd. a limited, non-exclusive, royalty-free license to store, process, and transmit that content solely as necessary to provide the Service. This license ends upon account deletion.
8.5 Trademarks. B4-UGO® and B4-UGO Safety™ are registered trademarks of B4-UGO Services Ltd. Unauthorized use is prohibited and may result in legal action.
8.6 Feedback. Any feedback, suggestions, or ideas you provide may be used by B4-UGO Services Ltd. without compensation or attribution and become the property of B4-UGO Services Ltd.
8.7 DMCA Notice. If you believe content on the Service infringes your copyright, submit a DMCA notice to support@b4-ugo.com.
8.8 Survival. This Intellectual Property section shall survive account termination. Your obligations regarding intellectual property continue indefinitely.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, share, and protect your personal information, including account data, GPS location, message content, notification logs, and trusted contact data. By using the Service, you consent to the data practices described in the Privacy Policy.
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
We are not liable for any harm arising from Service unavailability, delayed notifications, or failed message delivery.
11.1 Disclaimer of Warranties. THE SERVICE IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS," WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. We expressly disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, security, and timeliness. We specifically disclaim any warranty that emergency alerts will be received, trusted contacts will respond, GPS location will be accurate, or the Service will function as a substitute for emergency services.
11.2 Disclaimer of Liability. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, B4-UGO SERVICES LTD., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES OF ANY KIND.
11.3 Notification and Delivery Failures. We shall not be liable for delayed or failed delivery of emergency alerts, missed alerts, notifications not received by trusted contacts, push notifications not delivered due to device or OS restrictions, SMS messages not delivered due to carrier issues, emails not delivered due to spam filters or provider outages, or partial delivery of notifications.
11.4 Service and Technology Failures. We shall not be liable for service downtime, outages, maintenance periods, third-party service outages, cellular network failures, internet connectivity failures, device battery failure, mobile OS restrictions on background processing, GPS inaccuracy, loss or theft of your device, app deletion, or software conflicts.
11.5 User Configuration Errors. We shall not be liable for incorrect trusted contact information, expired phone numbers or email addresses, security code errors preventing timer cancellation, or failure to enable required permissions.
11.6 Third-Party Actions. We shall not be liable for actions or inactions of trusted contacts, third-party service provider failures, telecommunications carrier failures, or actions of emergency services.
11.7 Cap on Liability. Our total aggregate liability for any claims shall not exceed the greater of the amount you paid for the Service in the 12 months preceding the claim, or ONE HUNDRED CANADIAN DOLLARS (CAD $100.00). These limitations reflect the allocation of risk between the parties and are an essential basis of the bargain.
You agree to defend, indemnify, and hold harmless B4-UGO Services Ltd. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, costs, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13.1 By You. You may terminate your account at any time via Settings > Delete Account. See our Data Deletion Policy.
13.2 By Us. We may suspend or terminate your account at any time, with or without notice, for violation of these Terms, fraudulent activity, or other conduct we deem harmful to the Service or other users.
13.3 Effect of Termination. Upon termination, your access to the Service will cease. Data deletion follows our Data Deletion Policy.
13.4 Legal Compliance. We reserve the right to preserve records and suspend deletion requests when necessary to comply with legal obligations, including court orders, search warrants, production orders, subpoenas, or other lawful requests from authorized governmental authorities.
These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles. You consent to the exclusive jurisdiction of courts located in British Columbia, Canada for any disputes arising under these Terms.
Before filing any legal claim, you agree to first attempt to resolve the dispute informally by contacting us at support@b4-ugo.com.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
